These Terms and Conditions (“Terms”) govern your use of the Aipixo mobile application (“App”) operated by Aipixo (“we,” “us,” “our”). By downloading, installing, or using the App, you confirm that you agree to comply with these Terms. If you do not agree, do not use the App.
1. Eligibility and Acceptance
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to agree to these Terms. If you are under 18, your parent or legal guardian must consent to these Terms on your behalf. Your access and/or use of the App serves as confirmation that you agree to these Terms and our Privacy Policy.
2. Description of Service
Aipixo is an AI-powered photo generation app. Users browse templates, upload photos, and receive AI-transformed images. The App is available on iOS and Android.
3. User Accounts
The App operates with anonymous accounts only. No registration, sign-in, email, or password is required. A unique anonymous session is automatically created on your device. If you uninstall the App or switch devices, your anonymous session and locally stored data (favorites, preferences) may be permanently lost.
4. License and Use Restrictions
We grant you a non-exclusive, limited, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You agree not to:
- Reproduce, distribute, publicly display, or create derivative works from the App or its content
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Use automated systems, bots, or scrapers to access the App
- Circumvent subscription requirements, usage limits, or security measures
- Use the App for any unlawful, harmful, or fraudulent purpose
- Interfere with or disrupt the App’s functionality or servers
- Resell, sublicense, or commercially exploit the App or its content
- Share, distribute, or publish AI prompts or template configurations extracted from the App
5. AI Image Generation
5.1 Consent and Processing
Before your first AI generation, you will be asked to consent to sharing your photo with Google for AI processing, in compliance with Apple App Store Guidelines. You may revoke this consent at any time in Settings.
5.2 Photo Data
Photographs uploaded to the App are processed solely for AI image generation. The App does not perform facial recognition, create biometric templates, or use photos for any purpose other than generating the requested image.
5.3 No Guarantees
AI-generated images are produced by third-party services. We do not guarantee specific results, quality, accuracy, or likeness. Generation times may vary. Temporary service disruptions may occur.
6. User Content
6.1 Your Photos
You retain all ownership rights to the photos you upload. By uploading a photo, you grant us a limited, non-exclusive, royalty-free license to process, store, and transmit the photo solely for providing the AI generation service. You represent and warrant that:
- You own or have authorization to upload any photo you submit
- Your photos do not violate any third party’s intellectual property, privacy, or publicity rights
- Your photos do not contain illegal, harmful, threatening, abusive, hateful, or explicit content
- Your photos do not depict minors in any inappropriate context
6.2 Generated Images
Generated images are provided for your personal use. You may save, share, and use generated images subject to applicable third-party AI service terms. We do not claim ownership of generated images.
6.3 Content Removal
We reserve the right to refuse processing or remove any content that violates these Terms, without notice.
7. Intellectual Property
The App, including its design, templates, AI prompts, code, graphics, icons, and branding, is owned by Aipixo and protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.
8. Subscriptions and Payments
8.1 Plans
- Free: Limited access, including daily free templates
- Pro: Unlimited access to all templates, generation history, and premium features
8.2 Billing
- Subscriptions are billed through the Apple App Store (iOS) or Google Play Store (Android)
- Payment is charged to your app store account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- Renewal is charged within 24 hours prior to the end of the current period at the same rate
8.3 Free Trials
If offered, free trials automatically convert to paid subscriptions unless canceled before the trial expires. Any unused portion of a free trial is forfeited upon purchasing a subscription.
8.4 Price Changes
Subscription plans and pricing may change with prior notification. New pricing takes effect in the billing period following the current one.
8.5 Cancellation
You may cancel your subscription at any time through your device’s subscription settings:
- iOS: Settings > Apple ID > Subscriptions > Aipixo
- Android: Google Play Store > Subscriptions > Aipixo
Cancellation takes effect at the end of the current billing period. You retain access to Pro features until then.
8.6 Refunds
All purchases are final and non-refundable, except where required by applicable law. Payment processing is handled by the app store, not by Aipixo. For refund requests, contact Apple Support or Google Play Support.
8.7 Restore Purchases
If you reinstall the App or switch devices on the same platform, you can restore your subscription via Settings > Restore Purchases.
9. Push Notifications
The App may send push notifications about new templates, features, and updates. You can enable or disable notifications at any time through your device’s system settings.
10. Third-Party Services
The App integrates with third-party services as described in our Privacy Policy. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, content, or practices of third-party services.
11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that:
- The App will be uninterrupted, timely, error-free, or secure
- AI-generated results will meet your expectations or be accurate
- Defects will be corrected in a timely manner
- The App will be compatible with all devices or operating systems
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIPIXO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM:
- Your use of or inability to use the App
- Any AI-generated content or results
- Unauthorized access to or alteration of your data
- Any third-party service failures or interruptions
- Any content or conduct of other users
Our total aggregate liability for any claims arising from or related to the App shall not exceed the total amount you paid for the App or subscription in the 12 months preceding the claim, or $100 USD, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Aipixo, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third party’s rights
- Content you upload to the App
14. Dispute Resolution
14.1 Informal Resolution
Before filing any formal dispute, you agree to contact us at support@aipixo.app and attempt to resolve the matter informally for at least 30 days.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
14.3 Jurisdiction
Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
14.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
15. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aipixo regarding the use of the App, superseding any prior agreements.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. The updated version will be indicated by the “Last Updated” date. Continued use of the App after changes constitutes acceptance of the revised Terms.
